Terms and Conditions of Sale.

These terms and conditions form the basis of the contract between Garden Kit Limited and its customers. All goods and services supplied by Garden Kit Ltd shall be on these terms and conditions.

Garden Kit Ltd is entitled at any time to modify any of these conditions by issuing a new version of these conditions. Such new conditions shall apply to each supply of goods or services made after the issue of the new conditions.

Garden Kit Ltd can only conduct business with customers who pay within terms and comply with our conditions of sale.

Garden Kit Ltd will notify customers when services are complete. Machinery must be collected within 2 weeks of notification. After this time a storage charge of £10.00 per week, or part of, will be implemented. If no response is received from the customer within 6 weeks, we reserve the right to dispose of said goods or machinery to cover costs.

No goods or services will be released until payment is received in full.

Cheques that are not honoured by the customer’s bank and referred to drawer, or re-presented will incur an admin charge of £20.00 plus VAT each and every time they are returned.

Should any form of payment subsequently become invalid, Garden Kit Ltd reserve the right to collect goods for credit and they shall be held until funds have cleared. Any goods collected or returned for credit in order to settle an account, will be subject to a minimum 10% handling charge, and a collection charge, if new and unused.

Goods will remain the property of Garden Kit Ltd, until payment is received and cleared in full.

The Customer shall make all payments due to Garden Kit Ltd without any deduction whether by way of set off, counterclaim, discount, abatement or otherwise unless the Customer has a valid court order requiring an amount equal to such deduction to be paid by Garden Kit Ltd to the customer.

Garden Kit Ltd accepts no liability for delay or non-fulfilment of any term of the contract caused by force majeure, war, strikes, lock-outs, accident, fire, scarcity of materials, or any other cause not directly within the Company’s direct control.

Discrepancies or disputes must be reported in writing to Garden Kit Ltd immediately.

English Law shall be the proper law of the contract.

Purchase of goods or services from Garden Kit Ltd is an unqualified acceptance of all the above terms.
